Regulatory Notice: Some U.S. Foundries and Suppliers Must File New EEOC Form by Sept. 30

Note: Below is important information from the AFS Washington, D.C., office about a Sept. 30, 2019 deadline for foundries to file forms with the EEOC. AFS will be holding a timely webinar on Aug. 22, 2019, "Update on DOL’s Proposed Overtime Rule & Navigating the New EEO-1 Pay Data Requirements," which will provide an in-depth overview of the new EEO-1 Component 2 pay data requirements.

Many businesses, including some foundries and metalcasting suppliers, are required to submit additional employee data to the U.S Equal Employment Opportunity Commission (EEOC) by Sept. 30, 2019.

Employers with at least 100 employees and some federal contractors with at least 50 employees are required to submit an EEO-1 form (Component 1) each year. Component 1 of the EEO-1 form asks for the number of employees who work for the business sorted by 10 job categories, race/ethnicity and gender. This form hasn't changed from earlier years. Data is pulled from one pay period from October through December 2018 from a company’s wage data. Employers were required to submit 2018 Component 1 data by May 31, 2019.

On July 15, the EEOC opened its new Pay Data Collection Portal at https://eeoccomp2.norc.org. The web-based portal will collect the new Component 2 data for 2017 and 2018 from employers, including federal contractors. This includes reporting hours worked and pay information from employees' W-2 forms by race, ethnicity and sex. Component 2 data must be submitted by Sept. 30, 2019. 

Note: Federal contractors and other private employers, including foundries and suppliers, with fewer than 100 employees are NOT required to report Component 2 compensation data. Get ready to comply, but hold off until the end of September, as the pay data Component 2 form remains in litigation.
